7.            Declarations of Interest

 

Members were asked to declare at this point in the meeting any disclosable pecuniary interests or other registerable interests they might have in respect of business on the agenda, if they had not already done so in advance on the Register of Interests.

 

No interests were declared, but for the sake of transparency Cllr Fisher stated, in relation to Agenda Item 4, that the complainant had informed him in advance of their intention to submit the complaint and he had expressed no views about this.

8.            Exclusion of Press and Public

 

Resolved:  That the press and public be excluded from the meeting during consideration of the private report at Agenda Item 4 (Code of Conduct Complaint received in respect a City of York Councillor), on the grounds that it contains information relating to an individual, which is classed as exempt under paragraph 1 of Schedule 12A to Section 100A of the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) Order 2006.

9.            Code of Conduct Complaint Received in Respect of a City of York Councillor

 

Members considered a report on a Code of Conduct complaint received in respect of a City of York Councillor. Details of the complaint and circumstances were presented in the private report referred to in Minute 8 above.

 

Members were asked to determine whether the complaint received should be investigated, choosing one of the following available options:

a)   that no further action is required;

b)   that the matter be referred for formal investigation;

c)   that some form of informal resolution should be carried out. 

 

Having considered all the information provided, and the advice of the Independent Person, it was

 

Resolved:  That no further action is required.

 

Reason:     The Sub-Committee considers that the evidence does not demonstrate a potential breach of the Code of Conduct.
